A Chemung County restaurant is being sued.

A Pine City woman has filed a wrongful death lawsuit after her husband died of Hepatitis A after eating at Maple Lawn Dairy in Ashland.

Donald Rockwell died this past March after eating at the restaurant in October. He was 49 years old.

Diana Rockwell tells 18 News that she’s suing them so she can give their four children an opportunity to go to college.

Maple Lawn Dairy General Manager, Jamie Fortier, says the restaurant continues to follow all safety procedures. She also tells us that the food handler who allegedly spread the disease is still working there.

Fortier says they are sorry for the loss of Donald Rockwell.
